Waiver

1. Acknowledgement oaf Voluntary Participation

I, the undersigned participant (or parent/legal guardian where applicable), acknowledge that I am voluntarily registering to participate in extracurricular, sporting, fitness, wellness, educational, or recreational activities (the “Activities”) organised, managed, or facilitated by RiyActive (“the Company”) within the United Arab Emirates.
I confirm that participation is entirely optional and not compulsory, and that I am participating of my own free will.

2. Assumption of Risk

I fully understand and acknowledge that participation in the Activities involves inherent and unavoidable risks, including but not limited to:

Physical exertion
Minor or serious injury Illness, dehydration, heat-related conditions
Accidental contact with other participants
Equipment failure or misuse
Property loss or damage
Transportation-related incidents
Permanent disability or death

I voluntarily and knowingly assume all risks, whether foreseeable or unforeseeable, known or unknown, even if arising from the ordinary negligence of other participants or third parties.

3. Medical Fitness & Health Responsibility
I confirm that:

I am physically and mentally fit to participate in the Activities.
I have no medical condition, injury, or impairment that would place myself or others at risk.
I have sought medical advice where appropriate prior to participation.
I agree that RiyActive does not provide medical screening and accepts no responsibility for determining my fitness to participate.
I undertake to immediately notify RiyActive of any illness, injury, condition, or change in health status that may affect my safe participation.

4. Accuracy of Information & Duty to Update

I confirm that all personal, contact, emergency, and medical information provided to RiyActive is true, complete, and accurate.
I accept full responsibility for:
Updating RiyActive of any changes
Ensuring emergency contact details remain valid
I understand that failure to provide accurate or updated information may result in removal from Activities without refund, and RiyActive shall not be liable for any consequences arising from incorrect information.

5. Release, Waiver & Indemnity
To the maximum extent permitted under UAE law, I hereby:

Release, waive, and discharge RiyActive, its directors, owners, employees, contractors, volunteers, partners, sponsors, agents, venue operators, and affiliates from any and all claims, demands, losses, liabilities, costs, or causes of action arising from my participation in the Activities.
This includes claims relating to injury, illness, death, emotional distress, property damage, or financial loss, except where directly caused by RiyActive’s gross negligence or wilful misconduct.
I further agree to indemnify and hold harmless RiyActive from any claim brought by:

Myself
My family members
My dependents
Third parties

arising directly or indirectly from my participation or conduct.

6. Conduct, Discipline & Removal
I agree to:

Comply with all RiyActive policies, codes of conduct, safety rules, and instructions.
Respect UAE laws, cultural values, and local customs at all times.
RiyActive reserves the absolute right to remove or exclude any participant from training, matches, or events if, in its sole discretion, the participant:

a. Poses a safety risk
b. Fails to follow instructions
c. Displays misconduct
d. Breaches policies

Such removal may occur without refund.

7. No Guarantee of Supervision or Outcomes
I acknowledge that:

RiyActive does not guarantee constant supervision.
Participation does not guarantee skill development, selection, playing time, competition entry, or performance outcomes.
Coaching decisions are final and non-negotiable.

8. Insurance & Personal Property
I acknowledge and agree that:

RiyActive does not provide personal accident, medical, health, or property insurance.
I am solely responsible for obtaining my own insurance coverage if desired.
RiyActive accepts no liability for loss, theft, or damage to personal belongings brought to Activities or venues.

9. Emergency Treatment Authorisation

In the event of injury or medical emergency, I authorise RiyActive to:
1. Administer basic first aid where reasonably necessary.
2. Seek emergency medical assistance if required.
3. I acknowledge that all medical expenses incurred are my sole responsibility and that RiyActive shall not be liable for medical decisions made in good faith during an emergency.

10. Photography, Video & Media Consent
I grant RiyActive the right to:

Photograph, film, or record my participation during Activities.
Use such media for promotional, educational, or marketing purposes across digital and print platforms.
I waive any right to compensation, ownership, or approval of such materials unless otherwise agreed in writing.

11. Participants Under 18 Years of Age

Where the participant is under eighteen (18):
1. This waiver must be signed by a parent or legal guardian.
2. The parent/guardian confirms acceptance of full responsibility for the minor’s participation.
3. The parent/guardian agrees to all terms, releases, and indemnities on behalf of the minor.

12. Force Majeure

RiyActive shall not be liable for cancellation, postponement, or modification of Activities due to events beyond its reasonable control, including but not limited to:

Weather conditions
Government restrictions
Venue unavailability
Public health emergencies
Acts of God

Refunds, credits, or rescheduling remain at RiyActive’s discretion.

13. Severability

If any provision of this waiver is found to be unenforceable, the remaining provisions shall remain valid and enforceable.

14. Governing Law & Jurisdiction

This waiver shall be governed by and construed in accordance with the laws of the United Arab Emirates.
Any dispute shall be subject to the exclusive jurisdiction of the courts of the applicable Emirate.

15. Declaration & Acceptance
I confirm that:

I have read and fully understood this waiver.
I sign this document freely, knowingly, and voluntarily.
